Landmark Austrian Decision on Protection against Termination of Employees during Kurzarbeit (short work) | ZFZ Postcard Cases

The Austrian Supreme Court ruled in a landmark decision, published yesterday, that the Austrian statutory Kurzarbeit (short work) provisions do not provide companies‘ individual employees with protection against termination of their employment.

According to the decision, the aim of the regulations is to maintain the number of employees employed by the employer, with the focus being on the size of the workforce rather than on the individual.
