Restrukturierungen/Kündigungen/Entlassungen

Bestimmte Rechtsordnungen beinhalten strenge Restrukturierungs- und Kündigungsvorschriften, die von Arbeitgebern einzuhalten sind.

In Österreich ist der Arbeitgeber etwa verpflichtet, dem zuständigen Betriebsrat einen Änderungsvorschlag für das Unternehmen rechtzeitig mitzuteilen, damit der Betriebsrat darüber mit dem Arbeitgeber beraten kann. Zu solchen Änderungen gehören Betriebseinschränkungen, die Schließung oder Verlegung des Unternehmens, Massenentlassungen, Zusammenschlüsse mit anderen Unternehmen oder die Änderung des Geschäftszwecks oder der Organisation. Auch die Einführung neuer Prozesse oder erhebliche Restrukturierungsmaßnahmen können meldepflichtige Änderungen darstellen.

Ähnliche arbeitsrechtliche Regelungen gibt es auch in anderen Rechtsordnungen, in denen wir tätig sind. Betriebsratsmitglieder

In Europa genießen Betriebsratsmitglieder sowie Arbeitnehmer, die am Betriebsratswahlverfahren beteiligt sind, einen besonderen Schutz vor der Beendigung ihres Arbeitsverhältnisses.

Daher ist weder eine ordentliche noch eine außerordentliche Kündigung / Entlassung ohne (in der Regel vorherige) Genehmigung durch ein Gericht durchsetzbar.

Wir unterstützen unsere Mandanten regelmäßig bei der Beendigung von Arbeitsverhältnissen unter derartigen Umständen.

Kollektivverträge und Betriebsvereinbarungen

Ein Kollektivvertrag ist ein schriftlicher Vertrag, der zwischen Arbeitgeber- und Arbeitnehmerverbänden abgeschlossen wird, um (1) die Arbeitsbedingungen und (2) die Rechtsbeziehungen zwischen den Parteien des Kollektivvertrags zu regeln. Als allgemeine Regel gilt in bestimmten Rechtsordnungen, dass ein Kollektivvertrag für alle Unternehmen und alle Arbeitnehmer einer Branche abgeschlossen wird. Ein Kollektivvertrag enthält zwingende Bestimmungen, die sich im Rahmen des Kollektivvertrags direkt auf jeden einzelnen Arbeitsvertrag auswirken.

Betriebsvereinbarungen sind Vereinbarungen, die zwischen dem Betriebsrat (sofern vorhanden) und dem Arbeitgeber abgeschlossen werden. Sie müssen schriftlich abgefasst sein und dürfen nur spezifische Angelegenheiten regeln, die entweder gesetzlich oder durch die geltenden Kollektivverträge den Betriebsvereinbarungen vorbehalten sind.

Einige Punkte, wie die Einführung einer Disziplinarordnung oder bestimmter Kontrollmechanismen, dürfen nur bei Vorliegen einer Betriebsvereinbarung umgesetzt werden.

Diese Bestimmungen wirken sich direkt auf den individuellen Arbeitsvertrag aus und bestehen gleichzeitig parallel dazu.

Unser österreichisches Team berät unsere Mandanten regelmäßig zum österreichischen Arbeitsverfassungsgesetz. Dieses Gesetz enthält die grundlegenden Bestimmungen des in Österreich geltenden kollektiven Arbeitsrechts, die sich unter anderem mit Fragen des Betriebsrats und seiner Mitglieder, mit Betriebsvereinbarungen und Kollektivverträgen befassen. Es enthält aber auch wichtige Bestimmungen zum Kündigungsschutz.

Nationale und Konzern- und SE-Betriebsräte

Die Beziehung zwischen Arbeitgeber und Betriebsrat ist von größter Bedeutung.

Ein Betriebsrat ist berechtigt, die Einhaltung der gesetzlichen Regelungen in Bezug auf die Beschäftigten des Unternehmens zu überwachen. Zu diesem Zweck kann der Betriebsrat die im Unternehmen geführten Aufzeichnungen über die Vergütung der Mitarbeiter und andere mitarbeiterbezogene Informationen und Unterlagen einsehen.
