Lukas Wieser is a specialist in labour, employment and transportation law, as well as employment and commercial litigation with Zeiler Floyd Zadkovich.

Lukas has extensive experience advising clients in all aspects of labour and employment law and representing clients in employment litigations and trials before Austrian courts. He represents clients especially in cases of employment termination challenges as well as in discrimination and (sexual) harassment claims. His work also includes advising foreign and national clients in drafting various types of employment agreements, such as employment contracts and shop agreements, and advising in restructuring processes and transactions. He assists employers in the full range of industrial relations law, from representing them against unions and works councils, to representation against individual works council members. He also assists international and national clients in global mobility and employee immigration scenarios. Hiring and performance management as well as drafting contracts with executives are another focus of Lukas’ expertise.

Lukas also advises clients on data protection, focusing especially on employees’ data. He further advises and represents clients in disputes arising from franchise, distribution & agency agreements. Lukas’ practice further includes the constant support of clients in the transport and logistics sector. He also assists clients in commercial disputes and represents them before domestic courts.

Lukas supports his clients with in-house training in the form of in-house seminars and workshops on all labour law topics, from the implementation of new technical working methods (keyword: algorithmic management) to (better) termination management.

Lukas regularly lectures on employment law at national and international conferences and seminars, and has authored several publications in his field. Additionally, he is a lecturer on HR-issues at the University of Applied Science BFI Vienna.

He was admitted to the Austrian bar in 2016, is a graduate of the University of Vienna (Mag. iur. 2009) and the University of Barcelona (LL.M. 2015).

  • Ongoing support of a leading Austrian company in the electronics engineering and manufacturing services sector regarding various employment matters, including the drafting of employment and shop agreements, employee data protection and terminations of employment relationships.
  • Representation of a Lithuanian transport company in a debt collection case against an Austrian transport agency.
  • Advising an Austrian manufacturer of vehicle lighting systems and electronic components on employment and industrial relations matters, including working time scheme, shop agreements and employee’s IP rights. Representing the company in court proceedings against employees challenging their employment termination (Austrian courts).
  • Assisting a leading Spanish producer of sanitary ceramics with a strong position in Switzerland and Austria in restructuring their Austrian entity. Advising the company on all employment matters, conducting negotiations with the trade unions and the works council on a social plan, preparation of notices of termination and planning of overall reduction in force.
  • Assisting a leading Austrian construction company during the COVID-19 pandemic on the full range of employment and industrial relations issues, including interpretation of government relief schemes, facilitating changes of the workforce, drafting and adjustment of home-office arrangements and reductions in force.
  • Representing a former board member of an Austrian international gambling company in the negotiations of his separation from the company.
  • Ongoing employment law support of the Austrian subsidiary of an international auditing company, including the amendment of the working time scheme, the termination of employment relationship and the representation in court against former employees.
