  1. Personal data

Zeiler Floyd Zadkovich (“ZFZ”) is the trading name used by individual law firms providing professional legal services to clients globally, each being a member of Zeiler Floyd Zadkovich (A Swiss Verein) (“Verein”).

The individual ZFZ Firms as well as the Verein collect, process and use your personal data only with your consent or if retained or appointed by you for the purposes agreed with you or if there is any other legal basis under the General Data Protection Regulation (GDPR), in compliance with data protection and civil laws.

We solely collect personal data which we need to know to provide and perform our legal services or which you voluntarily provided to us.

Personal data includes all data containing information about personal or material circumstances, such as name, address, email address, phone number, date of birth, age, sex, social security number, video recordings, photos, voice recordings of individuals as well as biometrical data, such as fingerprints. Personal data may also include sensitive data, such as health data or data in relation to criminal proceedings.

  1. Access and erasure

As our client or as a data subject you have at all times – however, limited by our duty of professional secrecy as attorneys at law – a right to access your personal data stored, a right to obtain information about the origin and recipients of your personal data as well as the purpose of data processing, a right to rectification, a right to data portability, a right to object, a right to restriction of processing as well as a right to request that data which is inaccurate and/or unlawfully processed is made unavailable or erased.

We kindly ask you to give notice of any change of your personal data.

You may withdraw your consent to use your personal data at any time. You may send your request for access, erasure, rectification, objection and/or data portability, provided the latter request does not involve disproportionate efforts, to the address referred to in Section 11 below.

If you consider that the processing of your personal data is performed in violation of applicable data protection laws or otherwise violates your rights under data protection laws, you may lodge a complaint with the competent supervisory authority. The competent Austrian authority is the Data Protection Authority.

  1. Data security

Your personal data is protected by organisational and technical measures, including, but not limited to, measures affording protection against any unauthorized, unlawful or fortuitous access, processing, loss, use and manipulation.

Although we use all our efforts to maintain an appropriately high level of security at all times, we cannot rule out that information you provide to us via the Internet is viewed and used by others.

Please be advised that we do not accept any liability for the disclosure of any information due to any error not caused by us when data is transferred and/or third parties access data without authorisation (e.g. hacker attack on email accounts or telephones, interception of facsimiles).

  1. Use of data

We will process any data provided to us for no purposes other than those covered by a client-attorney-agreement or your consent or any provision in compliance with the GDPR, except for any use for statistical purposes if the data provided was rendered anonymous.

  1. Transfer of data to third parties

To perform our services we may have to transfer your data to third parties (e.g. opposing party, substitutes, insurance companies, service providers we are using and to whom we provide data, etc.), courts or authorities. Your data will be transferred solely on the basis of the General Data Protection Regulation, especially to perform our services or based on your prior consent.

Please be informed that in the context of providing our legal services, we regularly obtain from third parties information about you related to particular facts or cases.

Some of the above recipients of your personal data are located, or process your personal data, outside the country you reside in. The level of data protection in other countries may not be the same as in Austria. However, we will transfer your personal data only to countries in respect of which the EU Commission has decided that they have an appropriate level of data protection, or we will take measures to ensure that all recipients have an appropriate level of data protection. For this purpose, we adopt standard contractual clauses (2010/87/EC and/or 2004/915/EC).

  1. Report of data mishaps

We are committed to ensuring that any data mishap is identified at an early stage and immediately reported to you and/or the competent supervisory authority, including any affected data categories.

  1. Storage of data

We will store any data not longer than necessary to satisfy our contractual and/or legal obligations and to defend any liability claims.

This website uses cookies to make our offer more user-friendly, effective and secure.

A cookie is a small text file which we transfer via our web server to the cookie file of the browser on the hard drive of your computer. This website uses an IP anonymization feature provided by Google Analytics. Your IP address will therefore be truncated/anonymized by Google as soon as it receives it. On our behalf, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage to us. Google will not associate your IP address with any other data held by Google.

9. Matomo Analytics

This website uses Matomo Analytics. No cookies will be stored, IP Adresses will only be stored anonymously and no data leaves our server. No third party is involved in our Analytics Tracking.

You may choose to prevent this website from aggregating and analyzing the actions you take here. Doing so will protect your privacy, but will also prevent the owner from learning from your actions and creating a better experience for you and other users.

  1. Server log files

To optimise the system performance, use and provision of useful information about our services on this website, the website provider automatically collects and stores in server log files information your browser automatically transfers to us, including your internet protocol address (IP address), browser and language setting, operating system, referrer URL, internet service provider as well as date/time.

The above data is not combined with any personal data sources. We reserve the right to check such data on a later date if there is specific reason to believe that data is used unlawfully.
